Facts: An owner sued to evict a restaurant tenant for nonpayment of rent. The owner claimed that the tenant was holding over its rental term by refusing to move out of its space after it failed to exercise its renewal option under the lease. The owner argued that the tenant's holdover was damaging her because it was paying a rental rate less than what a prospective tenant was willing to pay.
