Negotiate Early Termination Options

Make sure that you carve out a right to an early termination of your lease. There are a variety of reasons why tenants would need to use that right. For example, you might run out of room in your space and the owner can’t accommodate expansion. Or your business model has changed and this site is no longer economically acceptable. Or the neighborhood has changed, with a downward effect on your profits. An early termination option also protects you if the owner has failed in major repair and maintenance obligations.
