Don't Say “Vacate” Unless You Mean It



It's not unreasonable to agree with the owner that giving up your space prematurely will trigger a lease default or another lease obligation, such as the payment of an early termination fee. But a common drafting error can leave you in a much worse situation than you bargained for. That's because many leases say that the lease default or obligation will be triggered if you “vacate” early. But to vacate a space, you must meet only one requirement: You must move out.
